Please find our terms and conditions of hire, which should be observed at all times, detailed below:

 

1.       A service charge of 20% of food and drink consumed will be added to the final invoice.

2.       The Hirer undertakes to ensure orderly conduct by members of their party. Any losses or damage caused to 2nd Floor On Clinton or its property, members of staff, other guests or their property will be the responsibility of the Hirer.  Such damage will include but are not limited to broken glasses, loss of or damage to bar equipment or furniture, damage to curtains, and lighting systems, damage to sound or music equipment whether belonging to 2nd Floor On Clinton or a supplier, damage to artwork, walls, and paintwork.  Specific charges for these losses to include cleaning and or replacement will be charged to the Hirer.  

3.       All lighting and sound equipment is only to be operated by a member of the staff unless otherwise stated.  Any tampering with the lighting, sound or AV equipment in the private room is strictly forbidden.  

4.       The Hirer must be available to liaise with the manager of 2nd Floor On Clinton at all times during the period of hire.  The manager will have full authority over the event.  

5.       Last call in the private room will be at 2.00 AM and guests must leave the room by 2.15 AM on the weekends.  On weekdays last call will be 1:00 AM and guest must leave by 1.15 AM .   

6.       The Hirer must ensure that 2nd Floor On Clinton is vacated at the time agreed when booked.  Should you wish to extend your hire period this will have to be authorized by the manager and an extra charge will be incurred.  

7.       The Hirer must provide a list of attendees if required.  Tickets may not be sold to members of the public for any event at 2nd Floor On Clinton unless prior arrangements have been made.  

8.       Any goods and items remaining on the premises are left at the owner’s risk.

9.       2nd Floor On Clinton provides full catering services.  If the hirer wishes to provide his or her own catering, this must be agreed to in writing with the management.   There will be a $5 per head charge for outside catering.  Hirer agrees to return catering facilities/room to 2nd Floor on Clinton in the condition that it was found and to remove all equipment not belonging to 2nd Floor on Clinton from the venue within 24 hours of the start of the event.  Should additional cleaning or storage be required, the hirer will be charged accordingly.  

10.   Final catering numbers must be confirmed 1 WEEK before the event.  These numbers are considered final and will be charges as such unless prior arrangements are agreed to in writing.  

11.   2nd Floor On Clinton cannot accept any liability for incidents or accidents caused by any guest due to the effects of alcohol.  Any illegal activity by guests will result in the party being shut down and the full amount agreed charged.  

12.   The Hirer is not entitled to use any areas of 2nd Floor On Clinton beyond the hired room, coatroom, and restroom.  

13.   Settlement terms:  

a.       A non-refundable $300.00 deposit is required on confirmation of booking.  Until receipt of this deposit 2nd Floor on Clinton will actively market room rental to other parties. 

                                                                           i.      Credit card details will be kept on file and hirer agrees by signing below that this card may be debited to cover any further costs that might be incurred whether they relate to further room hire fees, cancellation dues or anything else agreed to in this and any other contract entered into between the hirer and 2nd floor on Clinton . 

b.       CANCELLATION policy:

                                                                           i.      Deposits are non-refundable.

                                                                         ii.      NO further charges will be made if event is cancelled with 7 days (1 week) advance notice.

                                                                        iii.      If event is cancelled 7 to 2 days (48 hours) prior to event date and time 50% of the agreed minimum cost of the event will be charged.

                                                                       iv.      If event is cancelled 48 to 24 hours prior to event date and time 80% of the agreed minimum cost of the event will be charged.

                                                                         v.      If event is cancelled with less than 24 hours warning 100% of the agreed minimum cost will be charged.

 

c.       All credit card payments may be subject a 2.5% additional processing fee on the full amount of invoice.

 ***In exceptional circumstances 2nd Floor On Clinton may vary these Terms and Conditions.

By signing a room rental  contract and/or  providing us with a deposit for your party you confirm that::

  1. You have read, fully understand and agree to be bound by these conditions.

  2. You are entering into a legally binding contract between 2nd Floor On Clinton operated by Barramundi and owned by Torquay NY
